How to respond to a Request to Admit. Ontario. None.
Background: I am involved as a defendant in a defamation lawsuit. The plaintiffs are falsely accusing me of making 3 defamatory reports about them on the internet and of making threatening phone calls to one of the defendants. They obtained an order from Google (which I did not oppose) to get Google to give them a list of all ip addresses used by a third party, who actually posted the online articles. The report from Google shows that the email account used by the third party was supposedly created from a computer with the same IP address as my internet connection. That was the only time that my IP address appears on the list. After the account was created, several other ip addresses are shown used by the third party for differenet places in Canada, US, India, Brzail, etc. I operate my own web server out of my home (which is why I have a static ip address). I do not know how my ip address shows up on the Google report for that account creation only, but there are many possible explanations. Now the Plaintiffs want me to admit that I run those websites out of my home. I know they are setting this up as a trap. What they really want to ask is if the ip address provided by Google is mine or not, but instead have worded it in a different way. They have stated that they will be applying for a summary judgement against me next.… read more
