I am sorry to hear to about your problem with this other tenant.
It sounds like your child is making noises that a child would reasonably make and that you have taken steps to lessen the noise. The problem could also be the lack of sound proofing of the building you live in. In any case, your landlord may try to evict you for this problem by giving you a N5 Notice to End Tenancy for Interfering with Others. You do not have to move when you get this N5. If you do not move out, your landlord has to follow up with a L2 Application to End Tenancy and Evict a Tenant to the Landlord and Tenant Board of Ontario. A hearing will be scheduled whereby the Board will decide if you have interfered with your fellow tenant's reasonable enjoyment of his unit. However, the Board views noise made by children to be part of a child's behaviour unless it is excessive noise. You have the right to present evidence and witnesses at this hearing.
