So of course she has no right to say that that was part of your agreement when it wasn't. It wasn't your agreement in writing and actually it wasn't your agreement verbally because all she said was you could put it in if you wanted to.

So let her sue you and she will lose.

If she sues you in court she has to prove her case and you will testify under oath.

Yes the lease is still binding. But, she didn't give you what you were paying for and for that reason she very well may owe you rent back so if she sues you then you can counter claim and I can help you through the site.

The lease is clear and she is just wrong. You offered more than you were obligated to do and she said sure if you can. But you found you could not. It was something over and above the lease and she was not and is not entitled to it.

And she cannot raise the rent more than 2.2% for 2020. The law is clear.

You should stop paying anything above 2.2%.
