If your common law spouse is applying as a Skilled worker under the Express Entry, you and your daughter have most likely been included on his application as a accompanying dependents. If you husband later informs Canada Immigration that you are both non accompanying dependents, Canada Immigration will still need to have you do medical exams but will not process you for permanent resident status.

Yes that is possible for your common law partner to notify Canada Immigration because the application has not yet been processed to completion.

It is important to note that because your partner applied for PR under the EE, he had to compile a Comprehensive Ranking Score ( CRS) which determined whether he was given a Invitation to Apply for PR. Your qualifications may have helped your partner raise his score and if it did, he may not necessarily want to inform Canada Immigration to remove you as his accompanying dependent.

Regardless, if you partner does decide to remove you and your daughter from his application, you would have to apply for PR on your own. There are a number of ways you can do this but I would have to know more about your own job qualifications, experience, age and educational background as well as the reason you want to separate from your partner and whether this reason included abuse.
