VerifiedI just reviewed your post. Your mother passed away in 2013 but you are only now wanting to contest the will? The problem is that limitation act and wills estates variation act is likely to preclude you from varying the will unless there is some fact at I am missing given that at this stage the time for filing a claim to vary passed 60 after the date your mother passed away.
Step 1. Prepare a notice of claim to vary will
Step 2. File claim
Step 3. Serve claim
Step 4. Defendants prepare and file a reply and counter claim. log they don’t you get default judgment
Step 5. When you receive reply and counterclaim you prepare and file
Reply to counterclaim.
Step 6. Set trial management conference
Step 7. Conduct examinations for discovery
Step 8. Set trial date.The only point at which you will need affidavits are if you make an interim application.These are the steps.
