THIS IS A SEPARATION AGREEMENT DATED Between Lara H***** (Lara) AND Ahmad S****** (Ahmad) “Collectively parties & Individually – party “ Background a- Lara and Ahmad were married in Amman – Jordan, on August 20, 1990. b- They divorced in Amman – Jordan, on Feb 21, 2018 upon Lara's request. The parties will continue living separate and apart. c- The parties have made complete, fair and accurate disclosure to each other on all financial matters between them. d- The parties have each voluntarily into this agreement and both parties confirm that they are in sound mental health. In consideration of the mutual promises and covenants contained in this agreement, as well as the condition, means, needs and other circumstances of each spouse has been taken into consideration and other valuable consideration, the receipt and sufficiency of which consideration is acknowledged, the parties agree as follows. Living Separate and Apart a- The parties have lived separate and apart since divorce took place in Amman – Jordan on Feb 21, 2018. Spousal Maintenance a- Neither party claims entitlement to spousal maintenance. b- Both parties expressly waive any claims to spousal maintenance now and in the future, regardless of any change in circumstances experienced by either party. Matrimonial Home a- The matrimonial home is located at: *****, Ontario, L7M0E4 and is owned by the parties. b- Ahmad's interest in the Matrimonial Home will transferred to Lara upon payment by Lara the sum of $ 166,000.00 as follows - Lara will make a payment to Ahmad in the sum of $100,000.00 by certified cheque delivered to Ahmad or his designate. - Lara will make a payment to Shamel Shukri in the sum of $14,000.00. (The sum of $14,000.00 is based on the original sum that has been agreed upon by the parties in the sum of $25,000.00 less the sum of $11,000.00 that Lara has paid to Shamel for his university tuitions fees) by certified cheque delivered to Ahmad or his designate. - Lara will make a payment to Yanal Shukri in the sum of $41,000.00 by certified cheque delivered to Ahmad or his designate. c- Upon transfer of the Matrimonial Home, Lara will be solely responsible to pay all encumbrances registered against the Matrimonial Home. d- Lara will indemnify and hold Ahmad harmless from and against all obligations, and expenses, including attorney's fees, arising of or relating to the Matrimonial Home. Assets a- The parties acknowledge that they have agreed upon division of all the assets, owned or possessed by them as matrimonial property or separate property. b- The parties are in possession of all of those assets to which each in respectively entitled. Accordingly, neither makes claim to any assets in the possession of the other. Debts a- Lara shall be responsible for all costs associated in transferring the home from joint title to her name alone also to cover all payments for the existing mortgage in the amount of approximately $679,186,84. b- Neither party will incur any further debt or liability on the other party's credit, any debt accumulated as of the date of this agreement is the debt of the individual party, regardless if the debt was as a result of joint credit or accounts. General Release and terms a- Each party releases all claims whatsoever and however arising, whether under the laws of the Province of Ontario or any jurisdiction, including and without limiting the generality of the foregoing, whether arising by statute or at the common law and including action founded on constructive trust, resulting trust or unjust enrichment, which such party may now or hereafter have or acquire or be entitled to against the property of the other party, however and whenever acquired, including and without limiting the generality of the foregoing, personal, any income from such property or assets of the other party and any increase in the value of such property, or against the estate of the other party. b- Lara and Ahmad each acknowledg … read more
