So you can ask for them to consider the damages to the unit, and the fact that she used a dishonest approach to get her award and at the least the fees should not be paid to her at all.

The reason why these questions are very difficult for anyone to answer is that the Covid pandemic is unprecedented and what that means is there is no case law that we can rely on. Any changes in policies come and go sometimes in a day and there's no court that has yet considered what any of this means. As the courts reopen there will be massive lawsuits and then we will have a better understanding of what any of these new laws meant or will mean in the future.

For now I think you should call the tribunal tomorrow and ask them why someone would be receiving an order for double fees when there has been a fee waiver and they didn't pay them. This is a huge windfall that is unfair.

I don't think that judicial review would necessarily work in a case like this but I would hope that at your hearing this could be addressed.
