I am looking for a Canadian lawyer, ideally in Quebec.I live in Montreal, Quebec, Canada and would like a real estate or property lawyer to respond. I moved into my house almost 2 years ago and part of the existing fence in my backyard separating my house from my neighbour in back was leaning on our property. Eventually the city we live in inspected the fence and discovered the height of the fence was not to code. He has a pool and I do not. The height has to be 5 feet and it's not so the city ordered him to make it 5 feet tall. He asked me to pay half of my part on the dividing line. I originally agreed to be a good neighbour and I was naive but after speaking to friends and my uncle who is a lawyer I backed out which led him to send me a demand letter to pay or he will sue me.He argued that he thinks I'm responsible to pay for half, basically my part on the dividing line, because the fence was in poor condition so it needed to be changed. In Quebec I believe both neighbours sharing the fence are responsible to pay for maintenance. However this is not why the city ordered him to do anything with his fence. They actually emailed him listing the reasons and it had nothing to do with the fence's poor condition. One of the reasons was the height. Also I must mention there are emails between my neighbour and I when my neighbour was shopping around and the emails show that I'm alright with paying. Again this was because I'm new in the area and I believed his story about me having an obligation to pay since we both benefit from the privacy of the fence. When he found the company he wanted to hire, he invited me over along with the 2 other neighbours who live next door to him over to meet with the fence company owner to sign contracts about what we each owe for our portions. No one else showed up though. When I went to his house, he gave me a tour of his house, made me a drink etc while waiting for the company owner to arrive. He was nice with me because he knew I was going to contribute. When the company owner arrived, he made a contract addressed to me only with the amount that I owed for my portion. I signed, regrettably, and went home. Shortly after, when discussing with friends, I emailed the owner cancelling the contract which I have the right to do within 10 days of signing. That is when my neighbour got upset and told me a judge would order me to do it. We spoke a few times on the phone and I had suggested we keep the existing fence as I was fine with it and he build a new one on his property. He also could have simply added an extension to make it taller. I also suggested taking down your fence altogether but that wasnt an option for him since he has a pool. During one of our conversations, he made a comment that upset me. He told me that since I drive a nice car, I should not make a big deal over $1000. He inevitably emailed me a demand letter to which I never replied. He texted and called me many times to confirm I received it but I never replied. It got to the point I felt harassed and he even came to my house on a Friday night with a witness and recorded with his cell phone that he was putting the demand letter through the mail slot of my front door. I know he did this as I have a video doorbell. This happened at the end of last year. Then in January a registered letter was sent to my house but since I was at work it was left at the post office and I never picked it up. When I checked the tracking number later on, I found out it was returned to a notary's office at the end of Jan. 1-2 weeks ago a notary emailed me the same demand letter and this time he is claiming a higher amount as he wants me to also pay for the notary. I haven't replied at all to date.Am I responsible to pay for half of the fence on the dividing line?
