There is no such thing as being forced to retire.

A contract is frustrated when one of the parties cannot complete it. They could be taking the position that the contract is at an end because your father cannot work. But this is not forced retirement.

You cannot require an employer to keep an employee on when the employee clearly will never be able to complete their end of the contract.

So unfortunately your father is bound by the terms of the contract and if he is not entitled to extended health benefits as he never worked there long enough then he may be stuck.

But your father is lucky because he is in a union so he should speak to the union rep and confirm what his rights are and what if anything that union can do for him.
