Do you answer questions on estate law? I live in Manitoba…

We have only received a copy of the will. No other information than that.

Not that we are aware of. We have received nothing. One of the executors is resisting. He is being very difficult to deal with and being so unreasonable that the other executor’s hands are tied.

Thank you for your response. This does help a lot. I have another question.....I work in the financial services industry in Manitoba so I have dealt with many Manitoba wills but I have no experience with B.C. wills. In my experience the executors are charged with carrying out the will according to the wishes of the deceased as outlined in the will.....pretty straight forward. My Dad's will states that his brother (the executor who is the trouble maker) can live in his house until he moves or dies provided that he, at his own expense, pays all of the utilities, taxes and upkeep costs of the house. After he is done using the house then the house becomes part of the residue of the estate and goes to the beneficiaries. The executors are now telling my brothers and I that it was my Dad's wish to have the estate pay the costs of the house (utilities, taxes, upkeep) and they want to set up an account that will pay my Dad's brother $1,000.00 per month to cover these costs. In order to do this they need all of us beneficiaries to sign a directive because it is not in the will. My brother's and I do not feel that we should be signing this. The will specifically states "at his own expense" and we feel that if it states that in the will then those were my Dad's wishes. I should also add that this will was revised 2 weeks before his death. The two things that were changed were that he changed the executors (it used to be me and my brothers) and he added the life estate for his brother. My brothers and I just want this to be done but we do not feel that the estate should be paying the housing costs when the will states something very different.

Thank you. To date we have not been allowed in the house to go through my Dad's personal affects as well as some estate assets that are on the property. Is there a way to compel my uncle to let us have access to remove personal affects? Also, is there any way to ensure that my uncle maintains the property while he is using it since it is an estate asset? Will the property remain in my Dad's name until my uncle is done with it or does it change to the beneficiaries names?
