I had to leave my two bedroom rental loft/condo - pack and move out all my possessions within about 48 hours - after a burst pipe and flood. My landlord, Dorian, used the opportunity (and his insurance money) to completely update the unit, and then served me with an eviction notice citing damages. I have no doubt he wanted to raise the rent as rents have sky-rocketed in Toronto since I first moved in - a classic renoviction.During my tenancy I had been late with rent as my adult son was staying with me and he became very ill, in and out of hospital repeatedly. His diagnosis is schizophrenia. I am a single parent, working from home and this situation almost destroyed my business. If you have ever dealt with someone with serious mental illness you will understand. It makes normal life of any kind, much less running a business from home, almost impossible. I did keep going however, and always managed to catch up and pay rent, and there are no outstanding arrears.After I received the eviction notice, Dorian refused to return my last month's rent of 2600. He cited damage to the property as his reason for doing so, at about 14K, which was ridiculous. He took photos AFTER the flood, after the workers and fans and movers had tramped through the place, and attributed this to me. I took very good care of the unit during my tenancy, and have lots of photos to show how beautifully I kept the place. I also became friends with the head of the condo board, who visited me and saw the unit in great condition. The only point he has which is legitimate is that the upper loft/bedroom area was carpeted with old, white carpet that was very difficult to keep clean. I had two small dogs and I am sure they were a factor. I did have the carpet cleaned at least annually, and I placed area rugs overtop to protect it. But it was quite dirty at the time of the flood, and of course, all the people marching through made it worse. Prior to the flood I had actually written him to ask if it could be removed or replaced as I felt it was a health issue precisely because it was old and so difficult to keep clean - I was open to helping with the removal and new flooring. I have friends who work in renovations. That conversation went nowhere - he didn't even answer the email.Due to the flood the whole flooring was replaced throughout the unit, including the carpet, paid for by his insurance. So even though I acknowledge that the rug was dirty, it seems very unfair to withhold 2600 from me, especially given what happened afterward.Dorian kept telling me that it would be awhile before I could get back in. He stalled and stalled for months - while I moved from airbnb to airbnb. I moved five times during that time period - with all my things in storage. It was so exhausting and overwhelming, especially in the wake of my son's crisis. I had to move out of the city because I couldn't afford short term rentals in town. Thank heavens for my insurance coverage or I don't know what I would have done. Then finally, he sent me the wildly inflated eviction notice.It is now almost a year to the date of the flood (Jan 20, 2019) so I have only a few days to decide if I am going to file something against him to get back my last month's rent. I am still living in short term rentals as I cannot afford a decent place in the city - I have had to declare personal bankruptcy. I have been avoiding confronting him because it was all so stressful, but I am wondering if I stand a chance of getting my money back, if I go ahead and file in the next week.I did fine in my short term rentals until the last month when I ran into another crazy landlady, but that is another story, another question I have asked in a separate chat.
