Are you aware of other complaints as well as yours?
That's not acceptable. As an owner the council owes you a duty of care. This is the democratic process. They cannot insulate themselves by requiring you to speak to someone with only delegated authority who only answers to them.
I suggest you send the council a letter my registered mail. They are required to enforce the bylaws and one of the bylaws states all owners owe the other owners the right to peaceful enjoyment of your home and this is not being enforced when you cannot enjoy your own home.
You can threaten a lawsuit or a lawyer acting for you can as well.

I live in a gated strata community which houses 36 stacking townhomes. There are 9 quads, each with 4 suites, 2 above, and 2 below. I happen to own a top unit. My neighbour below me, is a ridiculously heavy smoker. I have lived in the complex for 1 1/2 years now, and have tried to make it work by putting air purifiers in each and every room in my home, running 24/7. Up till about 2 weeks ago, it was tolerable, even though on many occasions, I have had to re-wash my clean laundry as it came out of the dryer smelling like smoke, or on a few occasions, marijuana. The smoke was mainly in my laundry room which I keep shut all the time. 2 weeks ago, the smoke started to infiltrate my master bedroom, and en-suite. It starts between 10.30 - 11 pm, and the thick smell of smoke stays in the bathroom, and seeps out into my bedroom. I have had very little sleep the past couple of weeks, and had occasions where I was late to work on account of my lack of sleep. Was away for the Canada Day long weekend, and was back home last night. The problem continues. What can I do?? I have spoken to my neighbour to ask that he not smoke in the bedroom or master bath. When asked if he's doing anything different (as I only started getting the stench of smoke in my bedroom and master bath just 2 weeks ago), he insists he is not doing anything different. I have respiratory issues, and find it hard to breathe when the second hand smoke is thick in my bedroom and master bath like it has been every night for the last couple of weeks. … read more
