My father died a couple of years ago leaving his house to his six children in Alberta. One brother was given health directive, power of attorney and is now executor. Over the last few years of his life, my brother took out $140,000 on the line of credit for my dads house for personal expenses which has never been repaid. Now he says the probate is almost through. Here is some more information about the situation.

Father moved in with brother when mother died in 2006.
Don’t know what the arrangement was.
Father and brother bought cattle together. Business did not do well. Father got nothing, but spent thousands feeding cattle. As far as we know nothing sold has been credited to dad.
We have never been kept informed about dads finances, bank records, tax returns, etc. Bother not willing to share that information.
Brother had health directive and power of attorney and is now executor of will.
Dad never went anywhere or spent any money. He would have been receiving CPP, OAP, and a veteran cheque as he was a veteran.
Sister in law had signing authority on his bank account.
Doctor wanted to declare dad infirm several times over the years but brother wouldn’t allow it.
When dad fell and broke, I think he was declared infirm then.
Brother has taken $140,000 out of dads line of credit against his house without any of the other kids knowledge for keep his business afloat and for his living expenses
House was willed to all six kids equaly.
Probate is almost through. Will line of credit come off the value of house? Who will have to repay the line of credit.
Brother is executor of will.
What can be done about brother’s taking money out of house for personal benefit while power of attorney? What does he have authority to do now as executor? Our question is is there anything we can do to make the brother pay back what he has taken? Do we have to help pay the interest on the line of credit?
