My nephew lives on...

My nephew lives on Vancouver Island but his mother was granted full custody over my brother with the agreement that my brother speak with him every weekend ( he current live in Ontario and is active military). Despite this, initially she would let my nephew talk in the phone, then she was sent an iPad so my nephew could facetime with my brother but she has since stopped letting him speak. To my brother saying either he's busy or 'he doesnt want to talk to you', to now cutting off communication altogether whicb is in violation to what the judge stipulated. I now live in Vancouver. I have communicated with her a couple of times and even forwarded some gifts to her but she hasnt allowed ke to see my nephew who incidentally , was recently diagnosed with autism. As a single mother with a son who also is diagnosed with HFA ( high functioning autism), I empathised with her plight and reached out to her

Lawyer's Assistant: What steps have they taken? Have they filed any papers in Ontario family court?

Recently however I enquired after him but I havent received any reply whatsoever and I am concerned . us there anythimg I can do? Yes they have gone to court. They had a written agreement which was being fulfilled but then she decided to take matters to court to gain more money

I am not sure if my brother has. She has..as she has her parebts money to fall back on. He has been fighting by himself

So you're the child's aunt and I don't know how many questions of mine about the current litigation you can answer, but let's try.

Do you have a copy of the current existing order? I should see it because this is unusual.

Are they back in court now? Over what? Who started it?

Hello Sir thanks for responding. There is a current existing order but I do not have acces to it. I believe my brother does. I am not sure if they are back in court but my brother is looking to contest her actions. My nephew's mother started this court battle, not him. They were seeing a mediator and had an agreement in place before she decided to take this to court. He even got a paternity test done etc. He was involved in the care of his son. I just reached out to her as I am in the Vancouver area to touch base and to enquire after the welfare of my nephew. Shall I ask him to forward it to you? Some background: my brother has since married and his wife just had a baby girl so it maybe awkward asking him, but I have been concerned for quite a while now.

I don't do phone calls, and I wish that the site wouldn't offer calls with me for an extra charge.

I think you should check your site account to ensure that you know what you've been charged so far.

And do I see another question from you? I'm happy to look at it. Do you have a membership? Check that when you're on your site profile and ask customer service about anything you need to know. I'm not a site employee so I can't help you with such things.

I think you should get a copy of the order and send it to me. It can be a scan or a clear pic, attach it to this dialogue box. You're asking about potentially holding the mother in contempt of an order so I have to see what the order says exactly. Does that make sense?

My Question is as follows I live in Vancouver BC and part-time overseas.My Mother has been diagnosed with dementia and is currently in hospital receiving care. She is awaiting placement in a Residential care facility or possibly her home for further assessment. She is retired and widowed of 2 years and lives with my younger brother who has a drug habit. And has been back and forth to home and rehab after nuturing his habit. He has also Elderly and Financially Abused my Mother by previously acquiring a POA which had to be revoked when we discovered his abuse. His abuse lead the family home into receivership. And my wife had to step in and make minimum interest payments to avoid immediate foreclosure of the home. The home currently has to be sold to avoid bank foreclosure.And because my Mother can no longer afford to maintain it and will need care for her Dementia. My brother who is the main reason and cause of my Mother's financial insolvency is uncooperative and unsupportive of the plan to sell my Mother's home, having violent tendencies towards me and my wife. Currently he is changing around the home rearranging things to possibly renovate and rent out my Mother's home. Part of my brother's financial abuse of my Mother was forcing her to sign a document where she took out an additional mortgage on her home of $50,000 despite him knowing her diagnosis of Dementia, some of which he used for his drug habit. We would like to have the best resolution for this situation. We would like my Mother to receive the best care living conditions and peace of mind. I am currently over seas and coming to Vancouver shortly. I now have full enduring POA for my Mother.
