I have been offered A commercial job to supply framing on a apartment building project. There is already a CCDC-5A contract in place between the owner and another subcontract Framing company. The contract does not state any start dates or completion dates for this phase of the project. The project will be at a stage that framing can begin within the first ten days of November. The framing company that has signed the original Contract can not start framing until January 15 2020. The owner has offered my company the job as we can start on their estimated date for foundation completion. What would be the repercussions for signing another CCDC-5A contract knowing that there is already a contract that exists I do not know the reasons why the time frames between the owner and the original contractor are not lining up. I also do not know if this original contract is already in the litigation process.

We have only verbally accepted the job, but haven?t read or signed a new contract. My company taking on the project is pending on some private in term financing to carry our labour costs through the first stages of construction until the monies start coming in from progress payments I also wanted to ask the owner, if the original contract is already in litigation and for what reason.

I just want to have some assurance that if my company completes the work that the original subcontractor cannot have a lawsuit against my company as My company would not be the party that was in breach of the original contract.
