VerifiedHello! My name is Debra (formerly known as Legal Ease). Thank you for your question. I'm reviewing it now, and will post back again shortly.
It doesn't matter how long she has been with you and whether you are considered common law for family law issues would depend on the province.
In any event she an adopt the child. This would completely extinguish the biological father's rights. ( Really he is just a sperm donor and not a father in my view).
That way you never have to worry about him wanting to start a relationship with the child.
Without a legal adoption it is trickier as the law is not so clear about egg or sperm donors just yet though some provinces are better than others.
It would make sense to retain a lawyer that specializes in reproductive law as they would deal with this best.
