basically we perform cosmetic treatments on clients. we had a particular client that we had injected dermal filler for her lips. It did not settle well so the client requested to have it dissolve. For this type of procedure, its an injection in the area we are dissolving. We have to do a test patch on the arm to make sure there are no allergies. we did the test patch and waited 2-3 mins. No reaction as well the client stated that she has had this injection before and that she was fine. a few mins later, we checked her arm and we saw that she is indeed allergic to the product however we had already proceed with the service to dissolve her lips. Lips then started to swell. We provide her some benadrayl and in most cases the allergy clears up.
Client went home. An hour later client called to inform us that her face was swollen and that she is going to the hospital. They gave her medications and discharge her the following early morning. The client contacted us seeking reimbursement for her medications, uber to hospital, and loss wages for the following day loss of work. Out of courtesy I had agreed to pay it total of $800 and I sent her a release waiver. She has not signed it yet and the following day she is still swollen so she went to a walk in got additional medication and the doctor "said" for her to stay home. So she is claiming additional wages and medications. My question is if there was no negligence, so we still reimburse her .
