HI Legal Ease :)If you read the letter attached ( I hope I attached it, if not I can try again) from the food company who makes the sausages, etc.. they mentioned how the food is processing was changed to correct the error. what they did offer me (in good
faith the letter states) is to cover the cost fo the tooth replacement. The qoute from the oral surgeon was around 5ksorry there was a huge lag when pressing send, I switched browser. much better now :)I'm curious, if you look at the letter. they kind of admit fault, I'm not sure if I should just take the 5k or press further and how.

ok, what Costco did was email the company and cc'ed a sort of moderator or negotiator. The company replied saying we don't need the negotiator perhaps I'll reach out to him. I believe there is a 2 year limit, this happened in Aug 2017 so I think I have until this coming August. Should I reply to their email or just automatically send the letter to both companies. I'm just sworried they will take away this offer and then stall until Aug 2019 passed.reply to their email to decline the offer* or just file small claims court. by the way, is it more threatening to hire a personal injury lawyer or just do the small claims court?I reached out to a few lawyer and some many say its not worth it for them or not to expect too much.I appreciate your input and guidance :)

Hi Debra :) You were so great back in January with your advice. This is regarding a chicken sausage from Freshouse I bought from Costco that cracked a top pre molar right in half and I had to get it removed the next day:( So back in January, I told you the company only wanted to cover my replacement tooth and nothing else. I finally got back to them and (from my research) correctly asked for their insurance info. The executive assistant emailed back saying that its a one year max on the amount of time a claim can be put through to them, I told them it was actually two years and then she wanted to talk on the phone. We did and she said re-submit an offer, I did and it was basically to cover the tooth, straightening of the teeth (because some shifted) and I asked for $1000.00 (I should have asked for more, this is all so new to me and I was scared they wouldn't accept the $1000.00. She did accept and agreed not to give a lump sum but pay the dentist and orthodontist directly and give the $1000.00 to me. The thing is, I'm concerned about future costs, they say a implant tooth lasts about 10-16 years and I'm 34. And to be honest I think about my teeth every day, when I go to bed and when I wake up because my speech has changed somewhat, blisters on my tongue, cant eat the same foods, because the teeth have shifted somewhat inward towards my tongue on that side it pinches my tongue and I speak maybe half as much as I used to. It really has lead to depression as I live with it everyday. It has effected everything from how I eat to my relationship.So, I have about 1.5 - 2 months left before the SOL comes up. I'm afraid if I go through their insurance or take this to small claims, they will argue that, how do we really know the bone was actually in the sausage (even though, the company seems to have admitted it - I tooth lots of photos and they sent it to a 3rd party food testing company) and I noticed on their website that they don't sell chicken sausages or any sausages any more and it looks like they put up quality control awards as well. They show they one some quality award 6 months before I broke my tooth on what looks like a chicken joint.I can try to maybe ask for another couple of thousand for pain and suffering as they seem to really not want me to go through insurance but I'm just worried about future complications. I have to wear the braces for a year to correct the moved teeth, then get a lovely bone graph, let that heal for 4 months and then the implant.If I go to court and the judge doesn't see how I can prove liability, or why didn't I pursue treatment earlier that it may not work out for me. I don't know. what would you do? (of course I know it's my decision in the end but would greatly appreciate any guidance.) btw, this happened July of 2017.Ive spoken with many nice lawyers in person around where I live, they are all very nice and gave a between $3000-$10000 more than the originally $4200 offer to replace the tooth. But they didntn want to take the case because it wasn't worth it financially. I then learned that paralegals can represent you in court and some suggested just filing a claim with the courts and go through mediation. I do plan to do that with Costco in the next few weeks to try and get something for pain and suffering.I just wrote a small novel, so sorry, it's just times running out and I don't know if I want my day in court or just want to ensure future complication can be covered. I heard after the SOL or you sign the release form then that's it forever.

I emailed her back asking to consider including the future cost of a replacement tooth (as they have a life spane of about 15 years and I'm 34). Also, I keep googling that pain and suffering is usually 3 times the medical costs, is that at all accurate in Ontario small claims?
