You are not going to be able to do anything for the estate if you want to be able to renounce your executor position which you should do. The reason why is you need consent of the court to renounce after you take any steps.

And it is not prudent to act as executor. The taxation issue is valid and complex. You would also have to post a bond with the court.

So if the Will doesn't appoint an alternative executor your siblings will have to bring an application to the court in Quebec to appoint them and at the same time you will renounce.

Then they will deal with the estate in the usual way.

The estate account would be opened by them in Quebec.

There is no reason to probate the Will in BC as this was not his habitual place of residence and you would need to essentially probate the Will again in Quebec.

So unfortunately this is a bit more complex and it would be best for your siblings to retain a lawyer in Quebec. The law in Quebec is different than in the rest of the country and if that lawyer says it is better to probate in BC then that would be what your siblings should do.

One of you has to be the executor and it cannot be you. But if your sibling who gets stuck doing this doesn't want the work then they can hire a company to do the work for them or they can hire a lawyer for that matter. The lawyer would have a law clerk who deals with administering the estate.
