I am sorry for your loss and to hear of this difficult situation.
Does the Will mention the TFSA?
This a real concern for you then. The TFSA is not part of the estate and is not covered by the Will.
Your mother could have made it part of the estate by have the beneficiary be the estate. If she wanted to save probate fees but want all the children to share in the account she could have designated all three of you. As well, she could have had a specific provision in the Will stating her intention is for the TFSA to be shared.
So you will not succeed in court if you try and get an order that you are all three entitled to share in the TFSA.
