Hello, I went to a pub last night I had only $20 on me & had two wines, I was going to leave to go home at 9:30 & two men said no stay and play some cards. I don't remember anything else after this. Next thing I am in a back of a police car with head injuries. The officer was trying to provoke me to argue with him, all I said is I have had a rough week I witnessed a robbery & had called 911 at 3:00 in the morning & now I am a witness for this, it was very frightening. I have anxiety, panic attacks, depression and PTSD I was a victim of a crime when I was a child. I was at the hospital I heard the officer say "she doesn't like me very much". I have no idea why he would say this? Anyways, when the hospital released me they gave me a bag and I found a slip Charged with being Intoxicated in public place. I have bruises all over my arms face & back. The hospital did a cat scan. I don't know what happened I certainly didn't have the money on me to buy drinks, the mental health worker said, how can they charge you when you actually don't know what happened. I actually called the police dept and said I don't know what happened can you please tell me. They said the place was closing, I fell and couldn't walk they called a taxi who refused to drive me home so they called the police. Who threw me in the back of a cop car. Anyways, I spoke to the provincial court they told me they can't tell me what to do but I should speak to the prosecutor. I am in treatment for my mental health. Also, my $500 Beats headphones missing. Should I speak to the prosecutor. I don't know what happened. I just don't want this on my record. I feel since I was injured I should have been put in an ambulance. Anyways, I don't want to cause any extra stress. Any advise would be appreciated. Thank you.

Hello Debra,
The charge is "Being intoxicated in public place" contrary to Liquor Licence Act Sec 31(4). Thank you. My arms are all bruised & my back, I am not sure if I have memory loss from the head injury or something else. To be honest being thrown into a back of a police car when you have a head injury is pretty frightening. At least the doctor's & nurses were nice. The mental health worker said you don't know what happened. I was not causing trouble I fell in the pub hit my head and couldn't walk. I actually had to call the police this morning and this is what their report said. They said you must bruise easily, probably when they were throwing you in the back of the car they bruised your arms (also swollen)....said no assault took place. I have never been in any trouble. Thankfully, they did a cat scan, & my brain is fine. I am still very dizzy with headache.

I am terribly sorry to hear how hurt you have been but the good news and it is very good news is that you will NOT have a criminal record from this charge.

This is not a criminal charge. It is in the same arena as getting a speeding ticket. You pay a fine and it's done. There is no record at all.

This cannot affect you in any way in the least.
