He could have applied to restore his status within 90 days of April 6 but now it is too late to do this.

Unfortunately at this point all he can do is leave cannot and then apply for another visa.

I wish I had a better answer but there isn't one.

I actually think based on your facts and the fact that you are not American and so the cost of going home and coming back is high, that you may be able to get a Temporary Resident Permit for him that could last until your work permit expires.

This gives him special permission to stay when he would otherwise be out of status. His case is strong because he is a minor, and cannot be separated from his parents.

So I think that is absolutely the best approach to take.
