I feel badly for the salesperson but in fact from a legal point of view he is wrong and so is his employer.

Not that you should be concerned about his pay but it would be illegal for the employer to deduct this from his pay though that may be a tactic to get you to feel badly.

But what matters to you is that you don't owe this money legally. There was a clear offer of the truck at a set price. There was an acceptance of the offer by you. The offer did not have a typo. There was a clear meeting of the minds which is needed. That means you both were agreeing without a doubt. The written offer reflected the agreement and you accepted it.

So you don't owe this additional money.

And frankly if there was an error and you felt badly you could give the truck back which is not what they want either which is ridiculous. They are actually wanting you to pay much more than was agreed upon and not even saying come back with the truck. In fact I bet they would not take it back as it is now devalued.

So they are stuck and the dealer and not the salesperson has to absorb the loss if there even is one.

If there is a typo and the written contract does not reflect what was agreed to then he is correct.

A typo doesn't bind them. As I said it is about a meeting of the minds putting it legally. If the agreement was for the $49,198 and there was actually a typo in the written documents you do owe the money.

So it depends on the facts.

My concern is that the ad is what brought you into the dealership. Your spouse saw the price was less and assumed it was because you were paying cash. That is not really a reasonable explanation at this is almost a 25% reduction for cash and that is not logical.

But if the number was clearly discussed and accepted then it's not really a typo either. It was the sales person offering the wrong price and that would mean that this is not your spouse's fault and then you would be OK.

I doubt they will agree to return the truck. I don't think they will win in court either but it's just not crystal clear.

That's what I would do. I would say they are wrong and if you sue us you will lose because there was not a typo but an agreement about the price but because we feel badly we are making a good will offer and it is..... If you want to take it sign a release that makes it clear that this is the final price. If not we will see you in Court.

I think he was likely panicking and I think he is really concerned about his job. I feel badly too. But you are right. He could have just been totally honest and apologetic and asked for your help in making this right.

You can message or honestly you can ignore them or just send one letter and have it delivered by courier or mail that is sent today and with a signature.

You should write "without prejudice" on the top of their letter.

You can say you paid in full as per the agreement. The written agreement reflected the oral agreement and was checked repeatedly by others including the sales manager and you don't want to hear from them again.

I would be really surprised if they sue you.
