I had some mechanical work done on my vehicle as I was to go to the U.S. ON JUNE 30TH/17. I was referred this mechanic by two local friends and had asked him if he could fix up two issues, mainly being, put in a compressor with a/cfreon fill-up for which I left him two blank p.d. checks for approx. $422.00 each and a week later, since he knew I had to take this older vehicle to the U.S. AS i AM A DUAL CITIZEN AND I WAS

I am in GILBERT PLAINS, MANITOBA...ANYWAY TO CONTINUE...THEN I ASKED HIM ALSO IF HE COULD FIX THE STRUTS AND SHOCKS WHICH HE DID AND ON THAT LAST JOB I ASKED HIM TO CHECK ALL MY FLUIDS, CHANGE OIL AND FILTER AND CHECK THE AIR IN MY TIRES AND MY SPARE AND PULL OUT THE TOOLS NEEDED IN CASE OF A FLAT TIRE. SO ON FRIDAY, JUNE 30TH, I WAS LOADING MY CAR FOR TWO DAYS BUT ON FRIDAY MORNING I HAD THE TRUNK PACKED FULL WITH COOLERS OF FROZEN BAKED GOODS TO TAKE TO MY SON AND GRANDKIDS IN TEMECULA, CALIFORNIA AND BOXES OF JARS OF CANNED GOOD AND THE BACK SEAT WAS LOADED AND ALSO THE SPARE TIRE WAS PLACED ON THE FLOOR IN THE BACK SEAT BEHINE THE PASSENGER SIDE IN CASE I HAD A FLAT AND NOT TO TAKE OUT ALL THE BOXES/COOLERS. OUT. ANYWAY, i LEFT Gilbert Plains, thru Dauphin, M.b thru Brandon on the way to INTERNATIONAL PEACE GARDENS, U.S. BORDER ON MY WAY TO TEMECULA , CA. ABOUT 3:30 P.M. I FELT MY CAR SLOW DOWN AND THE NEEDLE WENT TO RED HOT AND SUDDENLY I SAW STEAM COMING OUT FROM UNDER THE HOOD AND I IMMEDIATELY PULLED OVER ON THE SHOULDER. MY CELL PHONE ONLY WOULD WORK ONCE I CROSSED THE u.s. border so i had no cell phone. I was about 7 km from the border and lucky a young couple stopped and they allowed me to use their phone to try to contact AAA to get a tow truck and this was June 30th, just before the big Canada 150th b.d. celebrations and now it was almost 4:00 p.m The girl told her husband to go visit their dad as they were on the way there and she would stay with me as we waited for over half an hour and no response from the dispatcher of AAA if they were going to send a tow truck. I was about 20 ahead of Boissevain or 7 km to the border. Anyway, the girl stayed with me and then it occurred to her to ask me to 'pop' the hood open and then antifreeze was spewing over the engine and

Lucky her husband came in about ten minutes and he noticed the radiator cap was missing and he proceeded to look down below into the engine area and he found it. He then asked me if I had any water and I always carried a case of bottled water and so he filled up the radiator with 5 bottles of water and told me, that probably the cap was loose or the mechanic did not fill up the radiator so he asked me to start the car and i did and then he suggested I drive towards the border so I would have a cell use and he told me there was a small town called Dunseith, about 15 miles past the border and for me to buy a gallon of

Please, just let me finish... antifreeze and so I proceeded asking them to follow me for at least 3 miles to make sure my car did not heat up again and so I did make it across the border to Dunseith, bought a gallon of MAX ANTIFREEZE/COOLANT 50/50 AND HAD A TRUCKER FILL UP THE FLUIDS AND THEN I HAD TO DECIDE TO I CONTINUE ANOTHER 2000 MILES TO TEMECULA, CA. OR RETURN BACK TO GILBERT PLAINS, 6 HOURS AWAY AS I STILL DID NOT FEEL COMFORTABLE WHAT IF THERE WAS A SMALL LEAK AND AI COULD NOT TAKE THE RISK TO BE ON THE u.s. side as the July 4th festivities would have everything closed to I decided to come back home as my trunk was fulll of 3 coolers with baked frozen food for my son and grandchildren and boxes of canned jars and it would have all spoiled should i have another breakdown...so i chose to return home and did make it by 11:00 p.m. that nite and it took me 2 hours to unload the car and notify my family who were terribly disappointed that i was not coming. I used up a $100 of gas and 12 hours of driving. And am stuck alone another month. Because i offered to pay him with 4. p.d. checks around $422 each over a 4 month period in case I did not get my refinancing i was expecting and he agreed to that form of payment. Now my friends say i should refuse payment and put a stop on those checks because it not only ruined my vacation plans but also, what if this was nite time and i was going thru the park and got stranded when there is no traffic or help and all my food would have been wasted and i would have had to wait till some one would help me plus now it would have been the July 1st holiday and maybe would not be able to get a tow truck. So what can i do. Can i put a stop payment due to the negligence of his work. I did call him and asked him to be honest with me when I asked him to check all my fluids and do an oil change and filter, i asked him specifically if he remembered filling my antifreeze or maybe he loosed the cap and was going to and did not and to that he responded, 'he did not remember'.....so what do you advise me to do as I still have e. p.d. checks owing about $1600, more or less and what an inconvenience his negligence to fill my radiator or tighten the cap caused me. I have witnesses and the couple who stayed by me and saw everything, i have their names and phone and addresses and I even gave the girl a jar of raspberry jam and i have proof of buying Antifreeze on my credit card and also proof of calling my U.S. AAA AND WAITING FOR OVER HALF AN HOUR AND NO RESPONSE. There that is my story...........
