Hi. I have been divorced almost 3 years (this October), and separated almost 4 years. My ex-husband wouldn't live the matrimonial home and it has taken this entire time to sell the house. During this time, he neglected to pay property tax. I was served papers last winter informing me the house was going for a tax sale. Long story short. The bank stepped in and paid the debt (after I gave $8000) in good faith to the bailiff. So, now that the house has been sold we have to divide the profits. It is my understanding that since he lived in the house, wouldn't move/leave he was responsible to pay the mortgage and expenses. I had to rent a house and pay all my expenses at this time. He also hasn't paid child expenses this entire time (but that is another ball of wax).

There are issues around the divorce and child expenses, theft of my tax return money, all sorts... but the house is my primary concern as it closes July 14th. And unless I get an injunction of sorts, we both will receive half the profits. Then I will have to go after him in court to recoup what I'm owed (which again is a lengthy list - he simply doesn't pay for my 4 children). Anyhow, the point is about $50 000 was tacked on to our existing mortgage because he didn't pay. Which affects my disbursement.
