I purchased a vehicle...

I purchased a vehicle on Monday and the one they gave me yesterday is not the one they showed me. And I feel so completely helpless right now.

It is a brand-new vehicle that I bought from the dealership. They showed me the van on Monday and I signed all the paperwork. Yesterday I was told that the van I purchased was not the van I looked at. I didn't know that until I got in it.

The van is in my driveway. I traded in my car. When I realized it wasn't the van I had seen they said that my car was already in the system and I couldn't have it. My option was to trade in the van to get another vehicle but it was now considered "used" so I would have to pay more money.I spoke with my salesman and 2 service managers. The second service manager was quite intimidating and I am afraid to go back to deal with him.

I have left a message for the dealership partner. I filed a complaint with AMVIC, the BBB and Chrysler.Chrysler said they can make a note of the complaint but that is as far as they can go because the rest is a legal contract.I do not have any copies of any of the paperwork that I signed. They were supposed to email it to me. Then they told me they would give it to me when I picked up the vehicle. And they didn't have it yesterday.I know how stupid this is and I shouldn't have left without copies of the paperwork. But I was already running late (which they knew) and I trusted that they were decent people. Why would they not give me the paperwork?Right now I feel incredibly helpless and I hate that. I am also afraid that if I have to go back there I will have to deal with the same sales managers and they are intimidating.

I don't know. That was all on the paperwork I signed. The van that they showed me on Monday was about $48000. I have no idea what the trade-in value on my vehicle was.

Oh.

So this is a mess for several reasons but aside from their being dishonest what is happening is that they are bullying you and you are afraid of them.

You should know exactly what you have to pay for any car you buy and you should never leave without paperwork and you should never, ever be stuck with a car you didn't buy and be made to think you will lose money if you give it back.

But I understand that you cannot take them on yourself and that is fine.

Here is what I suggest.

Right now send them a letter by Registered Mail (it is Friday and they must get this today so use a courier if you cannot send by same day post and in fact a courier may be cheaper). Set out the facts, make it clear that you will not accept the wrong van and that they have admitted that it is wrong but seem to be saying oddly, that you have to take a van you did not buy. That is clearly not the case.

Tell them that you have an appointment with a lawyer early next week and will instruct the lawyer to commence legal proceedings without further notice to them as this letter is going to constitute the demand letter if you see the lawyer before this is entirely resolved.

Then spend the rest of the time today finding a lawyer you can see on Monday or Tuesday.

As as start you can contact the Law Society and use their Lawyer Referral Service. You will be given the name of a lawyer and can consult with the lawyer and the first half hour will be free.
