What is the basis for a wrongful death lawsuit? The province

Customer Question

What is the basis for a wrongful death lawsuit?
JA: Can you tell me what state this is in? And do you have copies of the medical records?
Customer: The province is Alberta. Medical records are not available yet.
JA: Has anything been filed or reported?
Customer: The executor of the estate has been told to be served with the lawsuit tomorrow. It is my mother's estate (her death was May 2015) and she drove into an 87 year old man on a mobility scooter. He died two weeks later. He had dementia and did not look where he was going. My mother got a minor traffic charge.
JA: Anything else you want the lawyer to know before I connect you?
Customer: The value of the estate was 470,000. Can the estate be liable for an amount higher than that?
