I have been a board member of my Condo Assn for almost 10 years and would like some info regarding Restrictive Covenants. Our bylaws were updated during this period (don't have a specific date) but a resident is adamant that the Restrictive Covenant supersedes the bylaws. Is this so?
The Restrictive Covenant would have been issued to the developer at or around the original bylaws were drawn up in 1997. Would it still apply, especially since this is a Bareland Condo development and all units are privately owned.
