Here are my suggestions for how you should approach this. First, send the dealer a letter by registered mail. In the letter state that you have just discovered that you and your friend were misrepresented as to what your friend was signing because both of you had been clearly and expressly told that your friend was only cosigning for you. At no time did you or your friend ever agree that your friend would sign for the financing on his own. Had you been told that, you most assuredly would not have gone through with the deal. Tell them exactly what you want them to do, and give them a deadline for complying. Tell them that if they fail to comply you will take whatever legal steps you deem appropriate including commencing legal proceedings. If that does not work, I suggest that you next send a letter to head office of the dealership if there is one, setting out the facts and enclosing a copy of the letter that you sent to the dealer. Again, threaten a lawsuit. If neither of those options work, your next step could be to file a complaint with AMBIC. You can also consider filing a complaint with the Consumer Protection Branch, because this was an unfair business practise. If none of that works you can sue them. You can sue for up to $25,000 in Small Claims Court and self represent.
