Good day,
Curious what options are available for this situation. We have an employee that is a supervisor at the front desk of a hotel and has not been performing. During his yearly performance appraisal, numerous issues were brought up and we provided a 5 week timeline to get these points corrected which still has not been done. To let this person go will cost $10K but if we demote this person it could be viewed as constructive dismissal. Any advice?

Did you give him a written warning at the time of his evaluation?

No. We didn't want to incorporate a disciplinary action on top of the items we were going over with him. An email was sent to him regarding what was gone over in the appraisal and were laid out clearly with the time frame to complete.

In that email did you cover what you covered in the appraisal and set out clearly what must be done but then failed to say what the consequences were or did you provide something in that email that set out the consequences as well?
