In any event, you can't be left like this. You need to have the repairs made and so your next step would be to retain a lawyer to send them a letter threatening a lawsuit. Any lawyer will agree to do that. So just find some local lawyer and pay the lawyer to send a letter threatening a lawsuit. From there you may have to retain another lawyer and sue them and there are plenty of litigation lawyers who are looking for clients these days.

So are you saying that as soon as it is spring time they are going to make the repairs and it's just not possible now?

The reason why this is a difficult issue is that you don't have your own insurance. The condo is not liable for the damage because they didn't cause it but they are agreeing to absorb your costs anyway. So it's hard to see how you can sue the condo corporation and it's not their fault because the building wasn't adequately taken care of so really you should be suing the tenant because the tenant caused the damage.

At this point in time it seems that your best bet would be to wait and see if they are going to do the repairs in the spring because what can you do if you cannot threaten to sue the condo corporation and you can't because they may say they not going to pay then.

Yes. What you can do is sue the condo corporation because they promised you they would get this work done and they haven't. The condo corporation can then add the builder into the lawsuit and blame the builder.

Yes. The condo corporation should go after the builder. And you should request that. But what I am telling you is that you sue the condo corporation and then they join the builder into the action. That is how the legal system works.

But you can sue the condo corporation for up to $25,000 in Small Claims Court and can self represent.

It is also unreasonable to think that for the price you paid the site would gain you your own lawyer. You know how expensive lawyers are and then consider what you paid the site and the fact that I get a small portion of that amount as clearly the site has to make money too, do you really feel that I would be able to act for you?

As well, you are not being fair when you say you knew about suing. In fact you thought you should sue the insurers and I explained about suing the condo corporation and how they would then add the builder to the lawsuit.
