I am divorced from my husband who died a few months ago. My husband and I are on title to two homes. One home has my mother on title as my husband, mother and I built a home on the property she has owned for decades. Our Separation Agreement intended for him to have one house and me to have the house with my mother. After one year this did not prove affordable for me. We physically switched houses with the promise my mother could remain living in the house. He took in three roommates. Upon his death my mother and I rented out the vacant bedroom to a fourth. With my mother and the tenants rents we barely break even having to subsidize some months. My ex father in law is the Executor and he is now claim via a lawyer that his deceased son owns one third of one house and one half of the other. At this point there is not really any equity in either house. I don't believe the Executor is aware of the financial situation on either house. My ex husbands name has been removed from my mothers house. The Executor is also claiming that we are impeding the Estate by illegally collecting rents. These rents are the only way we can make mortgage and utility payments. We never changed the arrangement in the Separation Agreement and were subsequently divorced after we had changed the living arrangement. I think The Executor is claiming that the new Family Law has turned the ownership on these houses to Tenancy in Common although I doubt that would affect my mothers interest. Since there is no equity and we are pretty sure they are just after money, should we ignore this. We really cant afford legal fees and of course he is using estate money to pay for his side. Also of note the Sep Agree provided for and $1100 per month alimony to me. After three months and the switch in living arrange, I did not expect nor was paid this monthly pmt by my ex husband. My ex and I's relationship was always amicable and we were just trying to the best for each other and our family. So they think there is equity, we dont know what else they want and they seem to be ignoring the $1100 that I would have been paid. Frankly I would like to be bought out of the house I am living in, but with no equity not sure how that works. I would definately need some money to start anew.
