I am living in the United states and have an issue with access and custody with my son who lives in Brampton, Ontario Canada with his mother. We have been divorced (in the USA) since 2012 and she relocated, with the boy prior to this in 2011, back to Canada. She has since denied access to me repeatedly. I have visited at least 4 times and she will only bring him when the court requires it. She was forced to open a case here so that the question of custody and access can be decided.
It has not.
A settlement conference and case conference have produced little other than my agreement to pay child support. She has ignored virtually all recommendations that have come from each conference and is determined to force me out of my son's life. I had previously retained a lawyer but he simply maneuvered the case towards a trial and wanted me to use him as a clearinghouse for child support payments.
Her "issue" is that she claims I am somehow dangerous to her and the child which is almost laughable. I am a Maryland state schoolteacher who lost employment as a Pastor due to the divorce and have virtually no criminal record to speak of, save a few traffic tickets. She claims I am schizophrenic and ultimately dangerous and is relying on her training as a psychiatric nurse to substantiate these claims, however she has no evidence and her testimony would obviously be biased.
I have produced a letter from a licensed Mental Health Professional in Maryland USA that clearly states that there is no issue preventing me from having custody and/or access to my son which has been submitted to the court. In their defense, the court has reserved judgement until the Judge who is specific to this case (Hon. F. Van Melle) hears the case, per her case note.
I need to know how to file a summary judgement as there really is no issue here that requries a trial. I am aware that I need a factum, which is not impossible but no mean feat, and a form 14A and possibly B. What else will I need to make this happen? I need to see my son as he will need his father as he grows older; he is currently 5 and knows I am absent but isn't sure why.
