I am writing you from Alberta, Canada
My aunt passed away in February of 2010, and my uncle is the executor of her estate, however, he has refused to provide any information to the lawyer where my aunt’s original will is held so documents can be submitted to the courts for probate.
My mother was joint executor but upon her death in April of 2012 my uncle became the sole executor. My mother was very ill, and I can only assume because she was unable to find some documentation required and didn’t have the energy to look is why she hadn’t acted in a timely manner. My uncle bad mouthed and berated my mother for stalling and when she passed away I provided him with the file she had been collecting that I found when I cleaned out her house.
I have discussed this with him a number of times, but he still refuses to step-up and do the job that he has been asked to do.
Having seen the will in the file I provided him I know myself and 21 others were named as beneficiaries. I also found another copy of the will when I was going through more boxes of my aunt’s papers earlier this year, in addition to a number of years of bank statements and 15 years with of tax returns. I handed all this information over to the lawyer in August. She owned no property and had nothing for personal belongings to speak of. The furniture and house hold items were donated to charity.
Up until now I have kept what I know to myself, but I now have others named in the will asking me questions.
I sent my uncle a letter communicating my frustration with his stalling and met with the lawyer where the will is held in August trying to get this process going, however, this has not prompted any action.
I’m frustrated…there are beneficiaries who could really use the funds that she wanted them to have, there have been two that passed away this year and one other has terminal cancer. Realistically I know that even if documents were submitted to the courts today that it is still a couple years before final distribution of the estate, as CRA hold a portion of the funds until they are satisfied that all owed taxes are paid in full.
Is there anything that can be done that will not deplete the funds that are there? From the bank statements alone we are talking about over $400,000…that doesn’t include any other investment accounts she had at other financial institutions or investment offices.
Don’t know if you can help me or not but if you have any words of wisdom to share I would really appreciate it.
