My common law husband assaulted myself and our 4 1/2 year old son. We began a Ltd company that is in my name and I'm soley responsible for and have been all costs since, insurance, phone, payments on accounts owed. My partner through his son who worked for us also, asked to use the tools and equipment and work as usualy, which I agreed to short term. Once they had their paycheques a couple days later and had secured all company assets, they told me they were starting their own company. He has hid property, had a friend take some and hide in case I manage to get an order to get the company property back, I'm told. Hidden the large zoomboom thoughthe help of an RCMP Constable, who kept it for him on his property. He took payments from customers owed my company and took all of the jobs that the company had booked and finished them himself and collected payment for those. What can I do to stop this. I had just had a planned layoff when everything happened, we'd known well ahead about it. He's not paid me anything and my accounts are depleted with payments on company debts, with more very shortly to come due. I had trouble finding a lawyer close to where I live, there were few and none taking clients. Because the RCMP and Social Services strongly suggested I get one asap for the safety of our son, I rushed and paid a retainer with one recommended but I didn't like the way she informed me (or lack of) and handled the case. From the beginning I told her how time sensitive this was, that I had money to last us for 2 months for sure depending on how many more company debts came in. She told me that she did things by the law, properly and that company assets could not be used for the profit of another company without adequate compensation and that a spouse was not entitled to anything in my name, legally until our property division was finalized. After weeks of filling out and getting the most info for her, she would forward me letters from his lawyer asking for an immediate response, I'd drop what I was filling out and finding backup info for and spend a lot of time replying and showing proof that he was lying on several occaisions. She didn't give me any indication of what was priority or where we were in the process even though from the beginning I told her I did not know anything about legal processes. Over halfway through when after no information and her telling me not to try to take or access anything that my spouse had in his possession and to wait and be patient. I told her that I had been waiting and now had lost all chance of getting any property back to help by renting or selling to ease payments on debts and household expenses (my husband the carpenter did no maintenance for 3+ years on our home, with the excuse that he'd do it when we renovated and now I have very necessary repairs that are 2-3 times what they would have been because they are so far gone most things need replaced entirely not fixed). When I researched a little online, I asked if there was an emergency order we could get to get back the company assets temporarily. She got extremely annoyed and told me that those measures were for women of violence fleeing their homes for their lives and were temporary, 90 days at most and were for personal property. I agreed but said I'd seen some clauses for corporate assets somewhere in there as well. She said she didn't do quick fixes. I said all we needed was 30 days and that we were running out of time to get assets back for me to rent or liquidate for income. She got very mad and told me that if I was going to waste her time by telling her what to do (I hadn't, I had asked if there were other options available to help me now) and waste her time by pretending I knew the law, when she was the expert and I was questioning her, she'd drop my case right that minute. I panicked! I was at 5 or 6 weeks from the beginning of everything and was running out of time and money. I couldn't afford to start again. I apologized profusely, telling her I was not educated in the law but growing increasingly more burdened and to please proceed. She pressed me to get the initial long forms finished and sent to her. I told her I had been working on them and all financial information and proof but kept getting interupted to reply to her requests for responses to his lawyers letters. She said these forms were more important. She'd never property informed me of that until then. I hurried and finished the forms. With two days until I went to sign so they could file in court and serve his side, she told me that the nearest court date would be Oct end. I was shocked as never had I been told things would take that long. Then she asked me for a response to a letter from his lawyer. I replied and without asking for any clarification, almost immediately I got an email I was cc'd on to his lawyer saying she was no longer representing me. I called she wouldn't answer and in emails refused to discuss. Please help or advise!!
