I collected ei payments while I was working and they are investigating the claim can I go to jail for this?

No. You will not go to jail for this if this is your first offence.

You can be convicted and face fines and penalties and it can make you ineligible for EI for some time and make it harder to get. You will also have to pay all the money back of course and can end up with a criminal record. But that is not necessarily the case and if you pay them back right away and if it's the first time then it may work out fairly well for you this time.
