Did you take delivery of the car?

Did you make a deposit?

What do the papers say about cancellations? Please check the back.

Customer: replied 2 years ago.
No, we do not have the new car in, the dealer has it .We did not put any deposit in.We do not have the papers, so we do not know about the cancelation. We should go this afternoon for that.

Essentially you've entered into a binding contract but as nothing has been signed and you've not put in a deposit they may agree to let you out.

If not tell them you understand they have an obligation to do their very best to sell the car again and if they do you are off the hook. You can say you've been told that the very most they would be entitled to is liquidated damages which would be what they lost in terms of having to sell the car so perhaps advertising costs could be incurred for example.

Tell then that otherwise you are happy to have a court decide.
