My cousin is executor of her fathers estate, which includes the contents of a trunk of which was sent to our grandfather after our uncle died in WWII. She agreed verbally to gift me the trunk and it's contents. My request was in writing, her reply verbal but very clear, an known by both of us to be of great importance to me. NOw, she seems to have decided to revoke the gift. The revocation was in writing, and the fact that it was gifted to me is clear in this document. Can I take her to small claims court to request she honour her initial decision to gift it to me? If so, can I apply for an injunction to prevent her from giving this property to someone else before the case is heard? I live in Bridgewater, Nova Scotia, where the property is locate. She lives in New Minas Nova Scotia. Please help me as it is very important to me that she honour her commitment.
