Customer Question

We have a thirty foot right away which leads to our house and property, the owner of the right away is our neighbor . The right away is shown on a legal survey but has no additional descriptions or references to use. Is it legal to have family members temporarily park on the side of the right away when visiting. Our neighbor has posted no parking signs and says our family can't park there , our property has limited space for parking. We have used this right away for over 75 years and the legal survey of the right away was done in 1985 . Our new home has been here for 10 years and we have had no issues in the past . The original owner of the right away passed away and his son is the new owner and creating difficulties.

No, you do not have the right to park on the right of way. Your right is limited to using the right of way to access the property.
