VerifiedHello – my name is***** am a Canadian lawyer, and I’ll be happy to help with your question today. Typically, if your son asks, his lawyer could attend at the RCMP station for the interview, but the lawyer probably would not be allowed into the interview room. He can advise your son whether or not to answer questions, but if your son is giving a statement the police will typically record that, possibly video record that, and the only people in the room are usually the officer asking questions and the person being questioned. In some stations, the lawyer can actually listen to the questioning while it's going on. But the investigating officers want the story as the person being interviewed would tell it, without prompts or signals from legal counsel. Depending on what situation your son is in, he may need both a Family lawyer (if the child is his) as well as a Criminal Defense lawyer (if he is possibly going to be accused of neglecting the child's welfare). Those lawyers will have the expertise to answer your son's questions, and to best advise him -- given his exact situation -- on how he should conduct himself during the interview, including whether or not he should answer questions.
