In Penticton, BC, they do not have a bylaw that allows me to trim branches from a neighbors tree that are clogging my gutters and wrecking my yard. Can I do so legally?

The law is that you can trim overhanging branches so long as you do not harm the tree and so long as you do not enter onto the neighbour's property.You can also demand that the neighbour trim the branches as the branches are legally a nuisance if they are over the property line.
