VerifiedBy the sounds of it he does owe you the money as he breached the contract by never completing his duties. That being said, a small claims court action may be more trouble than it's worth- if you're only claiming $600, you should note that it costs $75 to issue a Claim and another $100 to set the matter down for trial. You can claim back these court costs as well if you're successful, but a trial wouldn't be for another year or so. If you hire a lawyer, then the costs you pay will certainly outweigh the $600.
One other option may be to have a lawyer draft a Demand Letter and send it to the contractor, demanding he pay you $600 (or perhaps even $500 so he thinks he's getting a break if he pays now) lest you commence legal action against him. I understand you've already sent him emails and demanded payment, but when such a letter comes from a lawyer on firm letterhead it is more intimidating and hopefully he'll pay without need to go through the time and expense of a court proceeding.
