Whether it was a search warrant under the Criminal Code or the Controlled Drugs and Substances Act, it must contain accurate information and clearly identify the exact location to be searched and the specific items to be searched for.
A copy of the warrant must be left at the location where the warrant is executed. It does not have to be given to the homeowner if they are not there at the time. It could merely be left in a conspicuous place such as on a table, taped to the door, or it could be provided to any occupant who is lawfully present and "in control" of the residence at the time. They do not need to be a regular occupant, owner or tenant.
Sometimes the police will not know the name of the subject of the warrant as they cannot determine it, or only have a "street" name in some cases. Again, as long as the location is clearly identified and the Information To Obtain sets out the grounds to believe that the items to be searched for will be found therein, a warrant can be authorized to search a premise without naming a person or the owner.
The disconnecting of the electronics does not invalidate the warrant.
However, the fact that the address on the warrant is incorrect would certainly invalidate a search warrant. As I indicated, it is required that the warrant must clearly identify the location to be searched. The physical address, as identified on the warrant, is the only address that the warrant authorizes the police to search. If they have searched your residence with a warrant that has another address on it, then this is not a valid warrant and the search and seizure would thereby be unlawful and any evidence obtained from an unauthorized search or on an invalid warrant, cannot be used in court.
