Hi. I am a woman in BC and am in the process of getting a divorce. I have a cohabitation agreement that is very clear. What we brought into the relationship will remain the person's etc. Also that we share the living expenses fifty fifty. My problem is that I had all the assets including the house which was totally in my name but he was paying half the mortgage and so if we split he would get a certain percentage of the equity in the house when it sold. This would be 20% in this case. He came into the marriage with an automobile. The difficulty is that the house was on Bowen Island and took five years to see (minus one month). I was selling the house and living there until a year ago when I rented it out. I preferred not to live there as I was working in Vancouver but kept thinking the house would sell so was there. He and I are both signed on the main mortgage and I lent him $117.00 and did a second mortgage to get that money. I have proof that it is his debt and he has been paying the full mortgage.
He is saying that since I was living in the house he thinks that he was not obligated to pay the mortgage payments or all the taxes, hydro etc. that I paid and had the house up for sale.
My lawyer knows he doesn't have money and so she is saying that I should disregard the taxes etc. part and just ask him for a small anount of money and yet he owes me 100,000 plus half our joint line of credit.
Do I have the right attitude of the lawyer or should I get another person?
