hi, i am trying to assist my brother who has been charged with sexual interference. he does not qualify for legal aid, Lawyers pro Bono just got back to him and said their are no clinics in his area (Kamloops) for at least 3 weeks. He had a previous conviction from about 10 yrs ago. this incident i do not believe happened so i have offered to assist if i can.
My brother was visiting a friend and his girlfriend who have 3 younger children, and there was another couple there as well, all men there worked for me at the time, both men had been talked to by me in regards ***** ***** past charge and conviction, because of the children is why i had brought this up. my brother sometimes has problems recognizing boundaries.
he does not and never has drank or done illegal drugs. these friends/co workers he was visiting this particular evening were smoking pot heavily and drinking, each time they smoke they go out on to the porch and the kids do not usually follow. since my brother does not partake in these activities he often does not follow either. but at one point one of the children was sitting / laying on the couch in the living room playing a game on a smartphone when the mom poked her head in from the kitchen and asked what he was doing with her daughter, it seemed to my brother that the question was more a conversation starter than a concern in anyway so he said she was playing a game or "they" were playing a game.. and the evening proceeded. about 4 or so hours later the parents both confronted him and accused him of touching their child. my brother was quite upset about this and in part because of their inebriated state just left the gathering. In the accusers statement there are many discrepancies between father and mother. He needs to appear in court this Monday, he does work but does not make much money. can you offer some guidance in what he should prepare ? i have him working on his statement, but we have no idea what he should have ready for court on Monday.. or is this the type of questions you answer thanks, Rik
