If the asset is put into joint names, then upon death of any joint titleholder, the remaining joint titleholders take over the property. This is not subject to the will of any of the titleholders, because on death the asset goes automatically the remaining titleholders, and is not subject to the estate of the deceased person.

So if the mother left an investment to two sons in joint names, and they continue to hold that investment in joint names, then upon the death of one son the surviving one will simply receive the full amount of the asset. There would be no involvement of the mother's will.

Even if the mother is still alive, and added the two sons to the investment, if one son passes away, then upon the death of the mother the remaining son is the final joint titleholder, and will take the full asset. Again this would not be subject to any term of the mother's will. Jointly held assets do not form part of the estate of the deceased person and so are not subject to being distributed according to the will.
