If you don't close, then you can be sued for breach of contract. The sellers would be able to potentially keep the deposit and seek damages for any loss or expense they suffer as a result of the breach. They have an obligation to take all reasonable steps to mitigate or minimize their loss by selling to someone else. So you could be required to pay for costs they have in getting a new sale, such as keeping the house in a condition to sell, advertising costs. Also, if they are not able, after reasonable efforts, to get the same purchase price as you agreed to pay, they could sue for the difference.
So you want to consider whether the risks in being sued may outweigh the risks of clean up costs if you discover an old oil tank.
