This question concerns Ontario Law:

My father and step-mother have been married for 25 years, living in their matrimonial home all that time. The house was only in her name. Both spouses are now involuntarily separated because she has been in hospital for 6 months and is suffering from dimensia.

They have recently sold their house, and my step-mother's Power of Attorney (her brother), acting both as POA & Real Estate agent, is now trying to take advantage of his sister's condition and is denying my father his half of the assets, offering him only 10% of the proceeds.

We began sensing something was amiss when my step-mother's Lawyer (clearly under orders from her POA) demanded a separation agreement. This is not something his true client (my step-mother) ever requested.

To counter-act this, my father went to the hospital to have his wife sign a declaration, stating simply that they both were happy to comply with the tenets of the Ontario Family Law Act and divide the proceeds from the property 50/50. Furthermore it stated that they did not seek a separation, and any actions in this regard did not reflect their interests. Both signed it, and 2 witnesses attended.

This does not seem to have helped as her lawyers have simply ignored it, saying her legal council was not present, that she was coerced by her husband, and that she repudiates the declaration, none of which is true.

To add to the problem, my father's lawyer keeps stating that we have no rights in the matter because his name was not on title. This advice goes contrary to any reading I have done on the subject, and I fear at best incompetence, or at worst, collusion on the part of our lawyer.

We try to have my step-mother fire her POA and appoint someone more trustworthy (who doesn't stand to inherit!), but in her weakened mental capacity, she does not understand everything that is going on and is reluctant to fire her brother.

My current fear, beyond losing this case, is that all the money from the property is now in a lawyers trust controlled by my step-mother's corrupt lawyer.

My father and step-mother are just two elderly pensioners who only want to take care of each other with the only money they'll have for the rest of their lives, and it is unconscionable that a family member may succeed in taking it all away from either of one them.

What actions can my father take to stop this travesty of justice? Furthermore, what actions can be taken against my step-mother's POA and her lawyer?
