Hello, five years ago my wife and I sold our first home. We lived in it for 3 years and we did some renos too it. We are not contractors or trades people and dont really have the slightest clue about doing most jobs. We put in some laminate flooring in the basement and then realized that the basement floor was cracking and had numerous cracks through out the floor. We didnt think much of it as we live in an area that is subject to constant ground movement and eveyone has just become used to the cracking and shifting of homes. We did remove some drywal and there was a crack in the corner of the floor going up the wall, we used some spray foam to fill in some of the cracks and to replace a little insulation that was missing. We then decided to sell the house a year or two later and filled out a property disclosre form. Not realizing this could be a defect, we were not trying to hide anything. I filled out my discloser form indicating there were cracks in the floor, but those should have been obvious when someone walked downstairs and into the laundry room. I did not however mention the crack in the corner that went up the wall. My agent told me that floor cracking was normal in our area and not to worry about it, she then sctatched it off the form. Now it has been five years, and I have become more familiar with homes and realize I should have said something more. Is it possible to be liable for this given the fact that we had no idea what kind of defect we were looking at or the fact that we. I am still unclear that this would actually be considered a defect, or does it look like we are trying to cover something up? Again not our intent. We simply didnt know or realize at the time.
