But as you are in the US you will be facing the battle of convincing a Court to allow you to move the child from her home, her mother, her community etc.
And it's never easy to do that.
In your case it's not going to be easy to argue that the child is not safe when until you heard of the adultery you were content to have the child live there and be driven in the van by her mother.
But your can argue that this was to be temporary and long term it's not in the best interests of your child to be raised in this environment where the child's needs are not given top priority and there is instability.
Your situation for sole or at least joint custody would be greatly improved if you moved back home.
I suggest you consult with a family lawyer by telephone who practices in the city where your child lives now.
